Justice and Christian Ethics is a study in the meaning and foundations of justice in modern society. Written from a theological perspective, its focus is upon the interaction of religion and law in their common pursuit of justice. Consideration is given, first, to the historical roots of justice in the classical tradition of virtue and in the biblical ideas of covenant and the righteousness of God. Subsequent chapters trace the relationships between justice, law and virtue in Puritanism, in Locke, and (...) in the founding documents of the American Republic in the late eighteenth century. In his concluding section, the author develops a covenantal interpretation of justice which includes both law and virtue, both human rights and the common good. Special attention is given to the pluralistic character of modern political societies; to criteria of distributive justice; and to religious resources for the renewal and transformation of justice. Drawing on a comprehensive, pan-national analysis of the corporatization of Canadian universities, as well as the notions of ‘parrhesiastic’ mentorship and practice, the authors examine the effects of the corporatized university, its implications for graduate nursing education and nursing's relative silence on the subject. With the preponderance of business interests, the increasing dependence of universities on industry funding, cults of efficiency, research intensivity, and the pursuit of profit so prevalent in today's corporatized university, we argue that philosophical presuppositions so crucial (...) to critical teaching, research, and reflection on nursing as a discipline are troublingly losing ground. We lament the erosion and fragmentation of philosophy, politics, and ethics as foundations for graduate education, which are increasingly perceived as less valuable, problematic, and in some cases, even burdensome. The effect of corporatization is the suppression of the critical engagement required of faculty in the everyday workings of institutions. We argue that, when the ideals of intellectual freedom, academic responsibility, duty, and obligation, as supported by philosophical thought, are smothered by the normalizing power of corporatized research agendas, philosophical approaches to inquiry and knowledge development become marginalized as scholars find themselves floundering in the face of a seeming ‘philosophy lost’. This is my reply to five extended critical assessments of my book Law as a Leap of Faith, appearing together in a symposium issue of Law and Philosophy. The critics are Kevin Toh, Luís Duarte d’Almeida and James Edwards, Fábio Perin Shecaira, Cristina Redondo, and Matthew Smith. The topics include H.L.A. Hart’s philosophical legacy, the moral claims of law, the nature of legal reasoning, the doctrine of legal positivism, and the possibility of alienation from law.

According to the motivational thesis (MT), we are justified in performing an action if and only if we perform that action for the right reason(s). Proponents of MT disagree about how it is best interpreted—about what count as reasons of the right kind. In _Fundamentals of Criminal Law_, Andrew Simester criticises an interpretation offered by John Gardner. Here, I explore some of Simester's reasons for objecting to that interpretation, and I argue—partly on the basis of those same reasons—that Simester's (...) own interpretation of MT should be revised. One is a science, the other an art; one useful, the other seemingly decorative, but mathematics and music share common origins in cult and mystery and have been linked throughout history. Emblems of Mind is Edward Rothstein’s classic exploration of their profound similarities, a journey into their “inner life.” Along the way, Rothstein explains how mathematics makes sense of space, how music tells a story, how theories are constructed, how melody is shaped. Our paper has three parts. In Part 1, we discuss John Gardner’s thesis that the non-elliptical ascription of agency to law is a necessary and irreducible part of any adequate explanation of the activities of legal officials. We consider three explananda which might conceivably necessitate this ascription, and conclude that none in fact does so. In Part 2, we discuss two other theses of Gardner’s: that it makes no sense to ascribe to law the claim that there are (...) legal obligations , and that law’s claim is the claim that there are moral obligations . We take issue with Gardner’s arguments for , and suggest that is unwarranted in the absence of an argument that law makes any claims at all. In Part 3, we briefly argue that, insofar as it issues requirements, there are certain claims that law cannot but make. We conclude that if Gardner is right that law’s claims are those of certain of its officials, it is law-making and not law-applying officials who make law’s claim. (shrink)

Current psychiatric classification adopts a disorder-focused diagnostic approach, as exemplified within ICD-11 and DSM-V. Although this approach has improved reliability of categorization, its validity and utility has been questioned (Harvey, Watkins, Mansell, & Shafran, 2004; Insel et al., 2009; Sanislow et al., 2010). Limitations include high comorbidity between supposedly distinct disorders; heterogeneity within diagnoses; limited treatment efficacy; and similarities across disorders in aetiology, latent symptom structure, and underlying biology. There is also evidence of transdiagnostic cognitive-behavioural processes (Harvey et al., 2004). (...) An alternative approach is therefore to focus on fundamental underlying mechanisms of psychopathology rather than observed symptom clusters. This article considers the possible benefits, hurdles, and steps towards implementation of this transdiagnostic mechanistic approach, using the example of repetitive negative thought. (shrink)

Mathematical pluralism can take one of three forms: (1) every consistent mathematical theory consists of truths about its own domain of individuals and relations; (2) every mathematical theory, consistent or inconsistent, consists of truths about its own (possibly uninteresting) domain of individuals and relations; and (3) the principal philosophies of mathematics are each based upon an insight or truth about the nature of mathematics that can be validated. (1) includes the multiverse approach to set theory. (2) helps us to understand (...) the significance of the distinguished non‐logical individual and relation terms of even inconsistent theories. (3) is a metaphilosophical form of mathematical pluralism and hasn't been discussed in the literature. This volume is the result of an exemplary effort to stimulate the study of the history of Latin American churches, to communicate the results of historical scholarship across national lines, and to bring many persons of diverse tendencies and religious backgrounds together in a unified enterprise. Cooperation at the Latin American level has been made difficult at times due to repression, internal wars, and opposition by conservative church leaders. Heroic efforts by Enrique Dussel and the Commission for the Study of Church History in Latin America brought forth an eleven-volume General History of the Church in Latin America. The present volume benefits from this magnanimous enterprise and includes many contributors to the larger series. The result is a singlevolume history of the churches, Catholic and Protestant, with many strengths and weaknesses. The editor structured the work to provide a chronological survey of the region in its first section, one which is succinct and useful for understanding the distant roots of the Catholic church. The middle section takes up regional histories and generally succeeds in conveying well the history up to the contemporary period. Including the treatment of the church in Chile, however, with that in Argentina, Paraguay, and Uruguay does not work well. Their civic cultures and ecclesiastical histories differ greatly, especially in this century. The final part devotes itself to special topics and becomes less historical than descriptive and evaluative. Here themes such as theology of liberation, Afro-American slavery, and religious orders receive special attention. This section offers much less reliable guidance to Latin American history, in my view. BOOK REVIEWS 331 One of the distinctive marks of the collaboration has been a determined effort (although not uniformally carried out) to recount history from the underside, from the point of view of the poor and oppressed, as well as from the perspective of religious and secular elite members who are thought to make history. This is an admirable and egalitarian ideal, but much basic research from this point of view has not been done. Within this section, Moises Sandoval provides a view of Hispanic Catholicism in the United States. He manages to sustain a view from the grassroots. The chapter, one of the best in the volume, could be required reading for any student of Nor,th American history. A few chapters may be marred by revisionist frameworks. The chapter on Protestantism is one. In my view, Jean Pierre Bastian's ideo· logical simplification does not allow him to give adequate consideration to the contemporary theological iand ecclesiological convictions behind notably diverse Protestant positions. Pentecostals account for 75-90 percent of Protestants in most Latin American countries; yet much of the history of Protestant churches in Latin America, as Bastian has re· counted it, has been irrelevant for explaining Pentecostal growth. This is not a minor consideration, since,the volume lacks a sense that Pentecostal churches are major religious organizations within Latin America. Similar tendencies mar the work of some Catholic writers who are wedded to the discourse of the " historical process of liberation." Such discourse leads to extravagant characterizations, as by Jose Comblin. He writes in the chapter on the church and human rights: "New democracies are totally unstable. Development has stagnated. There is no future in sight " (pp. 452-453). Comblin, a highly regiarded theologian, not a social scientist or historian, does not account for the great expansion (more than 2,000) of human rights organizations in Latin America. We are apt to wonder how a good God could possibly permit the many and frightful evils which infest the world. Aquinas, however, believed that all human beings are afflicted with "a terminal cancer of soul," for which pain and suffering are the (...) divinely-appointed remedies (340). If we are not cured, we will lose for ever the ultimate bliss of communion with God. At this rate we are to expect that the best people are precisely those who are liable to suffer the most (342). Aquinas would agree with Pope Gregory, who says that it is frequently difficult to understand the ways of providence, but never more so than "when things go ill with good people and well with bad people" (343). Stump concludes that what Aquinas's interpretation of Job, and his overall account of evil, has to show us is "that our approach to the problem of evil is a consequence of our attitude towards much larger issues, such as the nature of human happiness and the goal of human life" (356). The reader will have inferred that this is a remarkable volume. None of the contributions is to be sneezed at, and some are very impressive indeed. The hiddenness of God in Christ and "the relation between the Word Incarnate and human words for this Word" animate this study of Aquinas's christological epistemology; it is a study of Aquinas's understanding of "the mystery of Christ, and [of] human ways of signifying him" (1). And because "all human understanding and signification fails [sic] to reach Christ as he is," Schoot believes that all christological knowledge is primarily negative and heavily reliant on analogy (1). He applies to the names of Christ what another author (Mark Jordan) has applied to the divine names: "the surest approach to the divine is by the scrutiny of linguistic failure" (153). The structure of the book reflects these insights. In the first chapter the author stresses the negative character of christological language by reflecting upon Aquinas's use of mysterium in christology. The second chapter is an analysis of his use of "the concepts of signification, supposition, predication and reduplication," in the context of the most current knowledge of medieval grammar and logic (7). It is here that the author stresses Aquinas's strongly linguistic approach to christology, as well as the distinction between supposition ("standing for") and predication ("sig- 504 BOOK REVIEWS nification"), which will be crucial to his analysis of the hypostatic union in later chapters. In fact, "the whole of christology is built on the distinction between signification and supposition" (55). Schoot believes that Aquinas, following medieval "modist" grammarians, thought that "a fundamental parallel exists between different modes of signification, modes of understanding and modes of being" (43), and hence a linguistic approach is often a decisive entry into questions of theological (and christologiocal) epistemology and metaphysics. In this context, the author examines the distinction Aquinas made between a number of modes of signification. Chapter Three is devoted to Aquinas as a biblical theologian. His use of biblical names of Christ {over ninety in his commentary on Isaiah alone) suggests that "a large part of Aquinas' treatment of the person and life of the Word Incarnate is devoted to a discussion of names" (104), and that the fact that Christ is a mystery "is rooted in (his] being the 'name' of God" (105). Schoot finds that "Aquinas employs the same rules concerning signification examining those names as he does concerning the divine names" (193). Chapter Four applies the key insights of Aquinas's "theory of supposition to the theology of Christ incarnate" (194). Ian Ker has inherited the mantle of the late Charles Stephen Dessain as the finest textual expositor of the Newman corpus, and Ker's biography should become a standard reference tool in the field. Ker ap· prenticed under Dessain in the production of the monumental (31volume ) Letters and Diaries, and his biography shows his command of the materials of that as yet unfinished project. Ker's hook joins the biographies of W. Ward (1912) and M. Trevor (1962) as significant "lives of Newman" to consider, and it addresses their earlier shortcomings : Ward's inadequate appraisal of the Anglican Newman and Trevor's unconcern for Newman's theological writings. Of Newman's intellectual contribution, Ker's treatment is similar to Dessain's John Henry Newman, an exposition of the major themes and intellectual moves, and theologically-minded inquirers need read both. Ker offers the hook as a personal life, a literary appraisal, and an intellectual study. The personal life and literary analysis are ably carried off; Ker's background in English literature and his editorial work on the letters have served him well. The intellectual study takes the form of synopses of Newman's hooks and articles, which are woven into the chronological narrative of the life. This aspect of Ker's hook is by no means "the theological achievement of JHN" (cf. Tracy's work on Lonergan); such a project still awaits Newman studies and someone of the conceptual breadth of the late Jan Walgrave to achieve it. Ker provides accurate and readable summaries of Newman's writings, and if a biography is meant to introduce the sundry aspects of a person, especially a complex thinker like Newman, then Ker's treatment of the intellectual aspect offers a fine introduction. I shall consider these three dimensions of the biography, and first the personal life. Newman considered that a person's life is best told 888 BOOK REVIEWS through that person's correspondence. Ker's biography is approached chronologically, and Newman's published letters guide the tale. Newman 's advice is particularly apropos for his own biographer, since Newman 's hooks and articles often displayed a "reserve" in which his true feelings were couched and nuanced. His letters, especially to confidants, were candid and often hard-hitting, as when he described the Curia in these words: " And who is Propaganda? one sharp man of business, who works day and night, and dispatches his work quick off, to the East and West, a high dignitary, [perhaps an Archbishop], hut after all little more than a clerk... with two or.three clerks under him " (p. 519). (Ker displays some reserve himself, omitting Newman's episcopal aside.) Ker's use of the letters is most revealing during Newman's Roman Catholic period when he encountered opposition from Archbishop Manning and W. G. Ward in England, from Archbishop Cullen in Dublin, and from Cardinal Barnaho in Rome. One senses how the laity rallied round him. Some of Newman's most pungent thoughts on ·theological freedom, on the suspicious nature of the clergy toward educated laity, on the wherewithal to make an institution a genuine university, on the role of patience and.trust in God when authorities are hearing down, are to he found in Ker's choice of letters. With so much material to mine-Newman wrote 20,000 letters-it is understandable that Ker does not include, save rarely, what Newman's opponents were thinking. Ker's account of Newman's Anglican period is equally illuminating, and indeed it is a highlight of the biography. Natural philosophy encompassed all natural phenomena of the physical world. It sought to discover the physical causes of all natural effects and was little concerned with mathematics. By contrast, the exact mathematical sciences were narrowly confined to various computations that did not involve physical causes, functioning totally independently of natural philosophy. Although this began slowly to change in the late Middle Ages, a much more thoroughgoing union of natural philosophy and mathematics occurred in the seventeenth century and thereby made the (...) Scientific Revolution possible. The title of Isaac Newton's great work, The Mathematical Principles of Natural Philosophy, perfectly reflects the new relationship. Natural philosophy became the 'Great Mother of the Sciences', which by the nineteenth century had nourished the manifold chemical, physical, and biological sciences to maturity, thus enabling them to leave the 'Great Mother' and emerge as the multiplicity of independent sciences we know today. Michael Faraday’s laboratory experiments have dominated traditional histories of the electrical sciences in 1820s and 1830s Britain. However, as this article demonstrates, in the mining region of Cornwall, Robert Were Fox fashioned a very different approach to the study of electromagnetic phenomena. Here, it was the mine that provided the foremost site of scientific experimentation, with Fox employing these underground locations to measure the Earth’s heat and make claims over the existence of subterranean electrical currents. Yet securing philosophical claims cultivated (...) in mines proved challenging for Fox, with metropolitan audiences, including Faraday, loath to give credit to the results of these underground experiments. This article explores how Fox developed a way of modeling his mine experiments, using clay samples, to communicate knowledge from industrial Cornwall to urban centers of elite science. It argues that the mine was an epistemologically complex venue of scientific activity, at once seeming to provide a way of examining nature directly, without recourse to laboratory contrivance, while simultaneously being a place where knowledge claims were hard to verify without access to these physically challenging locations. In exploring Fox’s work, this study contributes to a growing literature of spatial investigation that takes the vertical as its unit of analysis. (shrink)

Is autonomy – governing yourself – compatible with letting yourself be governed by trust? This paper argues that autonomy is not only compatible with appropriate trust but actually requires it. Autonomy requires appropriate trust because it is undermined by inappropriate mistrust. An autonomous agent treats herself as answerable for her action-guiding commitments, where answerability requires openness to the rational influence of external, critical perspectives on those commitments. This openness to correction makes one vulnerable to manipulation and can be exploited in (...) ways that undermine autonomy instead of supporting it. We argue that autonomy is undermined by inappropriate trust, and that the inappropriateness lies in the agent’s failure to manifest appropriate responsiveness to evidence of untrustworthiness in the one trusted. The problem isn’t that autonomy requires dispensing with trust but that trust must itself be governed by appropriate responsiveness to evidence of untrustworthiness. Our view confronts two challenges. One challenge lies in explaining why you shouldn’t treat your vulnerability to manipulation as a general reason to let your trusting disposition lapse into an untrusting one. We argue that there is no such general reason to let your responsiveness to evidence of untrustworthiness be supplanted by a suspicious disposition to seek and require positive evidence of trustworthiness. A second, and deeper, challenge arises from the fact that in some especially sophisticated cases of manipulation there is no evidence of untrustworthiness to which you could respond. We argue that you cannot rationally cope with even this unresolvable risk of exploited trust by trusting only yourself. (shrink)
